Shopowners sue Prangin Mall
management

PENANG (Jan 16, 2007): Eight Prangin Mall shopowners are suing the shopping
complex management for failing to apply for strata title and mismanagement.
Judicial Commissioner John Louis O'Hara today ordered both parties to submit
their written submissions before May 10 on the application by the shopowners.
He gave the order after dismissing the complex developer and management's
application to set aside the suit brought by the shopowners.
"The defendants' application to strike out the writ of summons and statement
of claim by the plaintiffs is dismissed with costs," he added.
The shopowners had submitted an application to appoint receivers and
managers to replace Getaran Unggul Sdn Bhd, Prangin Mall Sdn Bhd and
Istimewa Sejati Sdn Bhd to manage the complex.
The plaintiffs are Ng Cheng Oo, Lai Saw Looi, Ch'ng Hun Pin, Wu Mei Eng,
Ch'ng Giap Theng Sdn Bhd, Heng Ah Leak, Loh Siam Kiang and Ch'ng Hun Boon.
They claim mismanagement as "temporary" stalls had been set up in the
complex and rentals collected without the approval of the local authorities.
O'Hara fixed May 10 to hear the application to appoint interim receivers and
managers to manage the complex. |
