RM12,000 award for house buyer

IPOH: Unlike some of her neighbours, K. Davagee decided to sue her housing
developer for late delivery of her double-storey house in Sungai Siput
instead of accepting about RM4,000 as settlement.
At the magistrate's court yesterday, the 49-year-old factory worker was
awarded damages amounting to RM11,800 with interest.
Magistrate Radzilawatee Abdul Rahman also ordered defendant Ipoh View Sdn
Bhd to bear the costs of the suit.
Davagee had bought a RM81,000 house and signed an agreement on May 4, 2001,
in which Ipoh View was to deliver vacant possession of the house on May 3,
2003, or pay damages at 10 per cent annual interest of the purchase price.
However, there was a delay of 528 days as the certificate of fitness for
occupation was only issued on Oct 13, 2004.
She filed the suit on Dec 22, 2006.
Devagee was represented by counsel Murali Chandran when obtaining judgment
yesterday. |
