Council will not issue statement

THE Kuala Selangor District Council will not be issuing any official
statement to declare Jalan Seroja 1/1 at the Sungai Buloh Country Resort a
public road.
Kuala Selangor District Council engineer Ahmad Jamzuri Mujaidi said the
council was not required to declare it officially because the road had
always been a public road under the Road, Building and Drainage Act, 1974
(Act 133).
Therefore, the developer, Glomac Berhad, has no right to close or allow
limited access to the road.
The council also clarified that the area where the bungalow lots was
situated was never a gated community as claimed by Glomac.
On Monday, the representative for SBCR Phase 4B and 4C Homeowners
Association representing 250 double-storey link and semi-detached
houseowners, Siti Zabedah Mohd Shariff, said the council must issue an
official statement on the decision.
“We haven’t heard of the decision (declaring the road a public road).
“A letter on its decision is necessary as proof in case of further dispute,”
she said.
Monday’s decision by the council, however, enraged 20 bungalow owners who
claim that that the road was exclusively for their use.
“Glomac cheated us. We will sue Glomac and the council,” said SBCR
Homeowners Association residents’ representative Gary Shaw.
Following the decision, the council had ordered Glomac to allow the public
access to the road.
The road has become a centre of dispute between the two groups of residents
— SBCR Homeowners Association which represented 20 bungalows owners and SBCR
Phase 4B and 4C Homeowners Association representing 250 double-storey
terrace and semi-detached house owners.
The bungalows owners had claimed that the road was for their exclusive use
as their project was a gated community, as stated in their agreement with
the developer.
They were adamant that the other group should not use the road as the
bungalow owners are paying monthly fees to Glomac to maintain the road under
the Deed of Mutual Covenants.
The double-storey and semi-detached house owners had complained that they
were forced to fill up forms at the guard house to enter Jalan Seroja 1/1.
Glomac Bhd had said that Jalan Seroja 1/1 was divided into two, with the
bungalows section being maintained by Glomac and the council had not taken
over its maintenance.
The council’s decision followed a meeting held on May 11.
